Workplace Training is mandatory per the Ministry of Labour (MOL), so why are so many employers out of compliance?
A part of an employer’s role is to ensure that both managers and employees are up to date on legislated trainings. In Ontario, employers are responsible for educating staff to create an inclusive and safe work environment by training on Health & Safety Awareness, Violence & Harassment Prevention and Disability Awareness. These are policies that most employers support, so why are so many out of compliance with the legislation?
Here are the top three reasons why we’ve found that employers fall out of compliance:
1) They are unsure of the training requirements.
Employers are experts in their own business, but not necessarily in employment law. Because of this, it’s not surprising they can get confused about which trainings are legally mandated, how they need to be delivered, and by who. Even if they complete the training, it is difficult to know if and when you’ve done enough, and if not, what’s left to do?
2) They are busy with their business.
Managing a company takes a lot of time and effort, and that’s before you take into account any “people management” concerns. Carving out the time in the day to develop and administer a training program is time spent many employers feel they can’t afford. And if they can’t find the time to develop the training, how can they expect to meet provincial deadlines for completing the training?
3) They lack the qualified staff and the budget.
Being compliant can be costly if you don’t have the resources. Many employers don’t have a qualified human resource team capable of facilitating the training, or perhaps the staff hours available. Involving your IT team to get the training online is a further investment of time and money many small businesses may not have to spare.
