New Job Protected Leaves Under Ontario's Employment Standards Act

Effective October 29, 2014, the Ontario Employment Standards Act is introducing 3 new job protected leaves: Family Caregiver Leave, Critically Ill Child Care Leave, and Crime-Related Death & Child Disappearance Leave. 

Family Caregiver Leave will allow an employee to care for a family member for up to 8 unpaid weeks without the risk of death stipulation that we see under Ontario's Family Medical Leave.

Critically Ill Child Care Leave is for employees that have been employed for at least 6 consecutive months and will provide up to 37 weeks of unpaid leave to provide care or support to their critically ill child.

Crime-Related Death & Child Disappearance Leave is for employees who have been employed for at least 6 consecutive months and are parents to a child who disappeared as a result of a crime. Employees will be entitled to up to 52 weeks of unpaid leave. Where it’s probable, considering the circumstances, that an employee’s child died as a result of a crime, the employee will be entitled to 104 weeks of unpaid leave.
