Another overtime class action lawsuit in Ontario! Is your payroll vendor protecting you?

A recent Ontario court decision has confirmed what many already knew: overtime class actions are alive and well in Canada. In Rosen v. BMO Nesbitt Burns Inc. (PDF), a Superior Court judge allowed such a class action, brought on behalf of a group of investment advisors, to proceed. To be prudent, employers should keep proper records of overtime. As these class actions become more common, as appears likely, employers will want to be prepared in the event that they are required to defend themselves against potential claims.
